Obama Bypasses Congress and Gives Amnesty to Illegal Aliens

Claiming that it makes "no sense" to remove illegal aliens who have not yet been convicted of felonies, the Department of Homeland Security (DHS) has announced its intention to conduct a file-by-file review of all active cases currently involved in removal proceedings. DHS has begun "closing" the cases of illegal aliens it claims should be allowed to stay.

Feebly disguised as an "enforcement priority," the policy announcement blatantly ignores the existing immigration laws as well as the constitutional separation of powers that gives Congress exclusive authority to make immigration policy. Its effect will be the exact opposite of what Congress intended when it voted down the DREAM Act last year as it opens the door to some 300,000 deportable aliens to be given work authorization.

Clearly, the Obama Administration's contempt for Congress and the American rule of law is outweighed only by its contempt for Americans who sincerely want our immigration laws enforced.

FAIR was first to swing into action to challenge this thinly disguised amnesty action. Last week we filed a Freedom of Information Act (FOIA) request and swiftly sent a letter to DHS Secretary Janet Napolitano challenging this policy change.
