Supreme Court Upholds Arizona’s E-Verify Law

email imageIn a landmark decision that has broad implications for immigration enforcement at the state level, the United States Supreme Court Thursday upheld the Arizona Legal Workers Act. Passed in 2007, the Act has two major components: (1) it requires Arizona employers to use the federal E-Verify system; and (2) it allows Arizona to suspend and/or revoke the business licenses of employers who knowingly hire illegal aliens. The Chamber of Commerce filed a lawsuit in 2007 seeking to strike down the Arizona law, arguing that both provisions were preempted by federal law. However, in Thursday’s 5-3 decision in Chamber of Commerce v. Whiting, 563 U.S. __ (2011), the Supreme Court rejected each one of the Chamber’s arguments and held that Arizona’s law is constitutional.

House Immigration Subcommittee Holds Hearing on Bill to Keep Criminal Aliens Behind Bars

email imageThe House Subcommittee on Immigration Policy and Enforcement held a hearing last week to debate Judiciary Chairman Rep. Lamar Smith’s (R-TX) new bill H.R. 1932, the “Keep Our Communities Safe Act.” H.R. 1932 grants the Secretary of Homeland Security (DHS) the authority to detain dangerous aliens who have been ordered deported, but cannot be removed. “Just because a criminal immigrant cannot be returned to their home country does not mean they should be freed into our communities. Dangerous criminal immigrants need to be detained,” Chairman Smith asserted in his opening remarks at the hearing.

Senator Rubio Holds His Ground against Amnesty

email imageSenator Marco Rubio (R-FL) is standing firm against the DREAM Act and other amnesty legislation for illegal aliens.  After Democrats reintroduced the DREAM Act this month, Rubio told the Spanish-language network, Telemundo, he would vote against it. (Id.) Senator Rubio then reiterated his opposition to the DREAM Act in an interview with Politico interview last week, saying that “we need an immigration system that works in order for America to grow and prosper economically. But we have to have laws. We have to have a legal immigration system.”

New Method of Transporting Criminal Funds across Borders

email imageThe Washington Post last week reported that criminal organizations are increasingly using prepaid cards to transport illicit funds and bring illegal activities across America’s borders. John Tobon, a senior agent with U.S. Immigration and Customs Enforcement (ICE) said that in the past year, the use of prepaid cards has “become the preferred means of paying couriers who transport illegal drugs across the U.S.” (Id.) U.S. officials estimate that over $20 billion in drug money crosses from the U.S. to Mexico each year.

Napolitano Extends Temporary Protected Status for Haitians

email imageHomeland Security (DHS) Secretary Janet Napolitano this month extended Temporary Protected Status (TPS) for Haitian nationals living in the United States.  TPS is a provision of the Immigration and Nationality Act (INA) under which the U.S. government may grant aliens (legal or illegal) authority to remain living and working in the U.S. temporarily if “there exist extraordinary and temporary conditions in the foreign state that prevent aliens who are nationals of the state from returning to the state in safety.” (INA § 244(b)(1)(C)) These conditions include earthquakes and other natural disasters resulting in a disruption of living conditions in the area.

Rohrabacher Seeks to End Health Care Subsidies for Illegal Aliens

email imageThis month Rep. Dana Rohrabacher (R-CA) reintroduced H.R. 1822, the “No Health Care Subsidies for Illegal Aliens Act,” to prevent illegal aliens from receiving health insurance subsidies under the new health care law. By applying a documentation provision currently part of the Medicaid to the new health care law, the legislation would close verification loopholes in the 2010 health care reform law (the Patient Protection and Affordable Care Act (P.L. 111-148)) to ensure U.S. taxpayers are not footing the bill for illegal aliens’ health care.

Utah Program Promotes Identity Theft While Aiding Pregnant Illegal Aliens

email imageThe Utah Department of Health has been issuing what appear to be false Social Security Numbers (SSNs) to pregnant illegal aliens who apply for a state and federally funded prenatal-care program, news outlets in Utah reported last week. The state administered program at issue, “Baby Your Baby,” provides low-income expectant mothers who meet certain qualifications prenatal healthcare services for up to two months while they wait for their Medicaid applications to be approved.

Obama Expands Work Program for Foreign Students

email imageIn a move that places American students at a disadvantage, the Obama Administration announced last week that it would expand the Optional Practical Training (OPT) program for foreign students.  Under the OPT program, foreign students are authorized to work in the U.S. under certain conditions: during annual vacation or other times when school is not in session; up to 20 hours per week while school is in session; or between 12 and 29 months following completion of a qualifying degree program.

Mexican Authorities Stop Trucks Filled with Illegal Aliens

email imageMexican authorities stopped two tractor-trailer trucks with in 513 illegal aliens from Central America and Asia last week.  Mexican authorities were able to detect the individuals jam-packed into the trucks—240 in the back of one tractor, 273 in the other—using X-ray technology at a southern Mexico checkpoint.

Drugs Flood Both Borders as Senators Worry about Delays

‘Secure’ Border Needs to Maintain National Guard Troops

Texas Senate Committee Guts Anti-Sanctuary City Measure

email imageIn a startling maneuver, the Texas Senate Transportation and Homeland Security Committee on Wednesday gutted the anti-sanctuary city bill that had been moving through the Texas legislature. By a unanimous vote (8-0), the committee members stripped House Bill 12, which would have prohibited public officials from restricting the enforcement of federal immigration law, and replaced it with Senate Bill 9.
